Is Bail Refundable in Washington State?

The answer depends on what type of money was paid.

Money deposited directly with the court is different from a bail bond premium paid to a bail bond company.

For example, Washington CrR 3.2 permits a court in certain circumstances to require a bond and a deposit into the court registry of no more than 10 percent of the bond amount. Under that provision, the deposit is returned when the conditions of release are performed and can be forfeited for violation of a condition.

Other cash-bail procedures can depend on the court’s order and applicable local rules.

Is a Bail Bond Premium the Same Thing as Cash Bail?

No.

A bail bond premium is the charge associated with providing the bail bond service. It should not be described as though it were money simply being held by the court.

Collateral is another separate issue. Washington regulations require bail bond businesses to maintain records concerning collateral and provide a collateral receipt identifying the property and the terms for its redemption.

Someone signing a bail bond agreement should therefore understand the difference between:

  • the premium, the court’s bail amount, and any collateral securing the agreement.
