What Factors Affect Bail in Washington?

Washington’s court rule contains specific factors courts may consider when deciding what is necessary to reasonably assure a defendant’s future appearance.

Those include the person’s history of responding to court orders; employment, education, training, treatment, volunteer work and similar activities; family ties; length of residence in the community; criminal record; community relationships; and the nature of the charge when it is relevant to the risk of nonappearance.

The rule also contains separate considerations when the court is evaluating danger to other people or the community. These include such matters as the nature of the charge, criminal record, prior threats or interference with victims or witnesses, prior violent conduct while on release, probation or parole, and past use or threatened use of firearms or other deadly weapons.

Does the Court Consider Ability to Pay?

Yes, in circumstances where the court determines that a secured or unsecured bond is necessary.

Current CrR 3.2 expressly states that the court is to consider the accused’s available financial resources when setting a bond intended to assure appearance. The rule contains a similar financial-resource requirement when a bond is imposed for specified public-safety concerns.
