What Happens If You Miss a Court Date?
Missing a required court appearance can affect both the criminal case and the person’s release status.
Washington’s court rule provides that when someone released on recognizance or bail fails to appear when required, the court may order forfeiture of the recognizance or money deposited and may direct the clerk to issue a bench warrant.
The court can also reconsider the person’s release conditions.
What if a Bail Bond Was Used?
A surety bond creates additional contractual obligations between the parties to the bond.
Washington regulations define a bail bond as a contract involving the defendant, the surety and/or the court that assures the defendant’s appearance as directed by the court.
Exactly what happens financially after a missed appearance depends on the court proceedings and the particular bail bond agreement. For that reason, this FAQ should not say that a cosigner automatically owes the entire bond the moment one court date is missed.
If someone realizes that a court appearance has been missed, they should promptly contact their attorney and, if a bail bond was used, their bail bond agent to determine what steps are available.
