Why Do People Use Bail Bonds in WA?
When a court requires a secured bond as a condition of release, one option may be to deposit the required cash with the court. Another may be to use a surety bond if the court has authorized one.
The practical reason many people consider a bail bond is that posting the entire required amount in cash may not be financially practical.
With a surety bond, a licensed bail bond company provides the bond required by the court under an agreement with the defendant and/or indemnitor. The customer pays the applicable premium and, depending on the circumstances and underwriting requirements, collateral may also be required.
Washington regulates bail bond agents and agencies through the Washington State Department of Licensing. Agents who post surety bonds must also meet the applicable surety-producer licensing requirements.
A Bail Bond Does Not Change the Criminal Case
The bond only addresses release from custody. It does not dismiss the charges, determine guilt, or replace any conditions imposed by the judge.
After release, the defendant still must attend required court proceedings and follow the court’s release order.
